Madras High Court Issues Notice on Plea Seeking Probe Into CJP Spokesperson Saurav Das's Background

Chennai: The Madras High Court on Friday issued notices to journalist and Cockroach Janta Party spokesperson Saurav Das and to several Union government authorities on a public interest petition that seeks an investigation into his background, the cancellation of his passport and Aadhaar card, and the blocking of his social media accounts.

The court, however, made no finding on the truth of the allegations contained in the petition, and the notices simply call for responses from those named as respondents.

A division bench comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice G Arul Murugan heard the petition and directed that the notices be returnable in six weeks. The hearing was then adjourned, which means the matter will come up again only after the respondents have had an opportunity to place their replies before the court.

In court procedure, the issue of notice at this preliminary stage is a routine step that allows a case to proceed to a fuller hearing; it is not a decision on the merits of the claims made by the petitioner.

The petition was filed by R Ganesh Kumar, a resident of Zamin Pallavaram in Chennai. According to reports of the proceedings, he alleged that Das had repeatedly made statements about the judiciary that were derogatory in nature, including remarks concerning the Chief Justice of India and other judges of the Supreme Court.

The petitioner argued that such statements warranted official scrutiny, and his counsel told the court that a representation made to the authorities on October 7 had received no response, which prompted the move to the High Court.

Appearing for the petitioner, advocate B Jagannath submitted that the manner in which Das spoke about the judiciary was not acceptable. He argued that the authorities' failure to act on the earlier representation justified judicial intervention. The court heard these preliminary submissions and decided to issue notice, giving the respondents time to respond to the detailed prayers set out in the petition.

The petition seeks a direction to the Union Ministry of Home Affairs and other authorities to conduct what it describes as a detailed, thorough and fair probe into the antecedents of Das and members of his family. In particular, it asks for an inquiry into the background of his mother and his biological father, who, according to the petition, live in Puducherry.

The petition identifies Das in its prayers by an alias as well, referring to him as Yogesh Sharma alias Saurav Das, and asks the court to examine questions about his identity and nationality.

Alongside the probe, the petition asks the authorities to take steps to cancel Das's passport and Aadhaar card if the proposed investigation establishes grounds for such action. This part of the prayer is conditional in nature: it does not ask the court to order cancellation immediately, but to act only if an inquiry were to substantiate the claims made.

The distinction matters, because the court has not ordered any cancellation at this stage, and no authority has yet been directed to withdraw either document.

A further prayer in the petition concerns social media. It seeks directions to the Ministry of Electronics and Information Technology to block Das's accounts on X, formerly known as Twitter, and on Instagram, and to prevent him from making further statements said to be derogatory to the judiciary. As with the other prayers, this relief has not been granted so far.

The court's order on Friday was limited to issuing notice, and the question of whether any blocking direction is warranted will be considered only after the respondents reply.

The list of respondents in the case is wide. It includes the Regional Passport Officer in Chennai, the Unique Identification Authority of India, and the Union ministries of Home Affairs, External Affairs, Law and Justice, and Electronics and Information Technology. Grievance officers representing X and Instagram are also among the respondents.

The breadth of this list reflects the range of reliefs sought, since different prayers would fall to different authorities if they were eventually granted.

The case raises questions that courts in India frequently have to balance. On one side stands the freedom of citizens, including journalists and political spokespersons, to speak critically about public institutions. On the other side stands the interest in protecting the dignity and authority of the judiciary, which is essential for public confidence in the justice system.

Courts draw a careful line between fair criticism, which is permitted, and statements that scandalise the court or obstruct the administration of justice, which can attract action. A petition of this kind therefore invites the court to examine not only the specific remarks alleged, but also the legal framework that governs speech about judges and courts.

It is also important to understand what a public interest litigation can and cannot do at its opening stage. A petitioner approaches the court with allegations and documents, and the court decides whether the matter deserves a hearing. Issuing notice does not mean the court accepts the allegations as true.

It means the court considers the questions raised serious enough to require answers from the other side. The respondents, including Das himself, will now have the chance to contest the claims, explain their position, and place their own material before the bench.

For Das, the case comes at a time when he is a prominent public figure. Reports describe him as an investigative journalist and a spokesperson for the Cockroach Janta Party, a youth-led political outfit. He has previously been involved in separate legal proceedings concerning social media commentary on the judiciary and the circulation of personal and family details.

Those proceedings are distinct from the present petition, and the outcome of this case will depend on its own record and arguments.

The petition also touches on sensitive personal questions, including family background and nationality. Such claims, when they appear in a petition, remain allegations until they are tested through evidence and adjudication. Responsible reporting therefore treats them as claims made by a petitioner, not as established facts, and notes that the court has not pronounced on them.

The six-week window for replies will be the first opportunity for the authorities and for Das to respond formally to these questions.

What happens next will follow the ordinary course of litigation. The respondents are expected to file their replies within the time granted, after which the petitioner may file a rejoinder. The bench will then hear arguments on whether any further directions are needed, including whether an investigation should be ordered or whether the social media prayers should be considered.

Until then, the case remains at a preliminary stage, and no adverse finding has been made against any party.

The development is nonetheless significant because it brings a set of contentious questions about speech, identity and official documents before one of the country's senior High Courts.

Whatever the eventual outcome, the proceedings will be watched closely by those interested in the limits of public comment on the judiciary, the use of public interest petitions to seek administrative action, and the safeguards that apply when a citizen's documents and online presence are at stake.
